Bills to Enhance Wildfire Mitigation, Preparedness and Response Efforts Signed

Governor Gavin Newsom signed a series of bills aimed at improving California’s wildfire prevention, mitigation, and response efforts, and continuing progress toward the state’s clean energy goals. The 22 bills cover various areas for a comprehensive approach to these issues and reflect recommendations in the Governor’s Strike Force report released in June 2019. The report provided guidance on how the state can build a safe, reliable, and affordable energy future.


Catastrophic Wildfire Prevention and Response

The Strike Force report recommended the state’s administration, California Public Utilities Commission, local communities, and utilities work together to reduce the incidence and severity of wildfires. The following legislation will step up both community resilience and the state’s response capabilities.

Mitigating Climate Change Through Clean Energy Policies

The Strike Force report recommended that given climate change is a core driver of heightened wildfire risk, the state must continue the transition to clean energy, mitigate risk, and build resilience. A More Effective CPUC with the Tools to Manage a Changing Utility Market 

The Strike Force report recommended an increased focus on effective safety regulation at the California Public Utilities Commission (CPUC). The following legislation strengthens utility regulation by expanding the CPUC’s safety review process.

In July 2019, the Legislature passed and the Governor signed wildfire safety and accountability legislation, which moved California toward a safer, more affordable, and reliable energy future. AB 1054 created a fairer allocation of catastrophic wildfire damages and will hold PG&E accountable for prioritizing safety, and required the California Public Utilities Commission to take a number of actions. 


 

Mercury Insurance Ends Two-Decade Long Stand-off

A battle that has raged for two decades over fees charged to insurance customers is finally coming to a close. In the largest property and casualty penalty and interest payment in California history, Mercury Insurance has agreed to a $41.2 million settlement. This comes after the State Supreme Court declined to hear the company’s appeal last month. 

In recent years, the case has gone back and forth as an Orange County judge ruled in Mercury’s favor and overturned the fine in 2016, then the Fourth Court of Appeal ruled the other way finding that the fees Mercury charged were not legal as the company’s agents were not insurance brokers. 

The fees in question were charged by Mercury Insurance’s auto insurance agents in 180,000 transactions from 1999 to 2004, according to the Department of Insurance. The totality of the fees was noted to cost consumers more than $27 million over that time. 

Although Mercury disputes the claims by the Department of Insurance, they decided to settle to “put an end to this 20-year-old plus dispute in the best interests of its customers, employees and other stakeholders.” The $41.2 million settlement includes the $27 million in fees charges, plus $8.1 million in interest and $5.5 million to settle a false advertising allegation that was pending trial.


 

Net Neutrality Remains Open Issues in California, U.S. Clash

Of the many legal battles between California and the Trump Administration, the fight over net neutrality has consistently been at the forefront. Under the leadership of Ajit Pai, the Federal Communication Commission has been rolling back many of the net neutrality regulations put into place over the last decade. To push back, California has enacted laws to restore Obama-era net neutrality rules. 

On Tuesday, October 1, Politico reported that the “U.S. Court of Appeals for the District of Columbia upheld the Federal Communications Commission’s effort to reverse federal regulation of internet service providers.” However, the court upheld part to allow states to impose more stringent regulations within their own jurisdiction, treating the FCC effort as the baseline. 

What becomes of the California law on this is ultimately unclear as the court also issued a stay while parties to the case decide on further actions. Senate Scott Wiener (San Francisco), author of the legislation for this law, noted that “there is a strong argument that the stay should be lifted.” 

Either way, until the stay is lifted, the state’s hands are tied when it comes to stricter rules on net neutrality.
